Terms and Conditions
§ 1 Services
Contractual services are valid when a client confirms the booking or when Rocky Tours confirms the clients booking or order. The booking person is responsible for all other persons mentioned in the confirmation. Modifications on number of participants have to be made to Rocky Tours as soon as they are known.
All services, prices, dates and other points written in the confirmation or other agreed points are binding. Additional agreements beyond the regular contractual services require a written confirmation by Rocky Tours.
Rocky Tours provides clients with an English or German speaking tour guide and kickbikes (on kickbike tour) that will be delivered in a good working condition and which must be returned by the client in the same condition at the end of the tour.
An exact adherence to the planned route and running order of the tour cannot be guaranteed. Therefore Rocky Tours reserves the right to change the meeting point, route or the tour content, in the event of impediments such as e.g. building sites or road blockages, or any unforeseen occurrences.
Tours will take place irrespective of weather conditions provided that the safety of the participants is not at risk.
§ 2 Payment and cancellation
The payment of the tour fee follows in cash after the tour on site unless otherwise agreed. Payment by credit card is not possible.
Clients may cancel their bookings free of charge if they haven´t paid yet. If the payment was already made apply following rules: for cancellations up to 24 hours before the tour the refund amounts 100% of the total fee, for any cancellation less than 24 hours before the tour (at short notice) there is no refund.
Rocky Tours reserves the right to cancel the tour due to force majeure, (severely) adverse weather conditions that may endanger the tour participants or any unforeseen impediments including consequences arising out of the COVID Pandemic. If the tour does not take place the full amount paid will be refunded or upon request, a new date for a tour may be selected and the fee paid will not be refunded. If the tour has already exceeded half of the possible duration of the tour, the hitherto efforts are to be reimbursed by the client.
§ 3 Liability
Clients participate in the tours at their own risk. Participants must decide themselves if they are in an appropriate state to be able to safely complete the tour.
Tour participants must obey traffic regulations at all times (StVO) and affirm that they are in good health condition to take part in the tour.
Rocky Tours is not liable for injury or damage caused by willful or negligent behavior of tour participants.
Clients will be held responsible for any damage to the equipment provided them by Rocky Tours with the exception of flat tires or mechanical malfunctions which are not the fault of the client. Rocky Tours reserves the right to inquire and assess the damages made and thereupon determines the nature of damage accordingly.
Moreover, Rocky Tours reserves the right to exclude clients if they act through gross negligence or sustain disruptive behavior on a tour despite a fair warning to desist. In this case, if the payment was conducted Rocky Tours will retain the paid fee. Extra costs incurred through the discontinuation of the tour or damages arising out of the distraction must be paid by the persons responsible for disrupting the tour.
Rocky Tours is liable for damages to persons or property only if the damage is clearly caused by Rocky Tours or otherwise caused by the actions of Rocky Tours by gross negligence or on purpose. Such claims must be made directly to Rocky Tours. Exclusion of liability is valid in the case of hidden defects or material defects.
§ 4 Data Privacy
Rocky Tours is obliged to adhere to the regulations stipulated in the General Data Privacy Regulation (GDPR), Austrian Data Protection Act (DSG) and Telecommunication Act (TKG) regarding the processing of personal data.
All personal data made available to Rocky Tours by the customer will be processed electronically and will only be used for contractual or customer service purposes. During the tours photos and videos may be taken. With booking the tour you take into notice that the photos and videos that you are on may be published on different social media sites. § 5 Copyright
All texts, pictures, videos and other published materials here underly copyrights of Rocky Tours Salzburg. Any reproduction or rendition of the whole or part of them are not allowed without prior written consent.
§ 6 Miscellaneous
All agreements between the customer and Rocky Tours are governed by and construed under the laws of the Austria. Place of jurisdiction and performance is Salzburg.
Should individual clauses in this Terms and Conditions be legally ineffective, this does not affect the validity of the remaining clauses.
In case of differences in the language versions the German version of the terms and conditions prevails.
